Terms of Service

You must be at least 13 years old to use the Service, and at least 18 (or the age of majority in your jurisdiction) to enter into paid plans or make purchases. You agree to provide accurate, current information when registering, to keep your login credentials confidential, and to be responsible for all activity that occurs under your account. Notify us promptly of any unauthorized access.

Hues AI is an AI-driven imaging studio purpose-built for jewelry, fashion, and e-commerce. The Service ingests inputs you provide — including sketches, CAD files, flat lays, and product photographs — and produces rendered images, videos, and other visual assets. The Service is continuously evolving; we may add, modify, or remove features at any time, and we may impose limits on usage, storage, or output to maintain quality and stability.

The Service operates on a credit system. New accounts receive a one-time allotment of free credits, and additional credits or subscription plans may be purchased through our checkout. Each generation consumes credits according to the pricing in effect at the time of use.

• Billing: Payments are processed by our third-party payment provider. By providing payment information, you authorize us to charge the applicable fees and any taxes.
• Renewals: Subscription plans renew automatically at the end of each billing period unless cancelled before the renewal date.
• Refunds: Fees and credits are non-refundable except where required by law. Unused credits do not have monetary value and may expire, be capped, or be forfeited as set out in your plan.
• Pricing changes: We may change pricing or credit costs with reasonable notice; changes will not affect already-purchased plans within the current term.

“Input Content” means anything you upload, submit, or transmit to the Service (e.g., sketches, CAD files, reference photos, prompts). “Output Content” means the images, videos, and other materials the Service produces from your Input Content. You represent and warrant that you own, or have all necessary rights, licenses, and permissions to use, your Input Content, and that your Input Content does not infringe or violate any third-party rights or applicable law.

You retain ownership of your Input Content. You grant Hues AI a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, and modify your Input Content solely as necessary to operate, secure, and improve the Service. We do not sell your Input Content, and we will not use it to train public-facing foundation models without your consent.

Subject to these Terms and full payment for any applicable plan, you own the Output Content generated for your account and may use it for personal and commercial purposes — including catalogs, advertising, social media, and product listings. Because AI-generated material may not be eligible for copyright protection in some jurisdictions, we make no guarantee that Output Content is protectable as a work of authorship.

You are solely responsible for ensuring that your use of Output Content complies with applicable law and respects third-party rights, including trademarks, design rights, rights of publicity, and brand guidelines.

You agree not to use the Service to:

• upload or generate content that is unlawful, infringing, defamatory, deceptive, harassing, hateful, or sexually explicit, or that depicts identifiable individuals without permission;
• upload designs, sketches, or imagery to which you do not have the necessary rights, or that you know or should know infringe another party’s intellectual property;
• reverse engineer, decompile, or attempt to extract the underlying source code, models, or weights of the Service;
• scrape the Service, circumvent rate limits, or use the Service to train, fine-tune, or build a competing AI model or imagery service;
• introduce malware, attempt unauthorized access, or otherwise interfere with the integrity or performance of the Service.

We may suspend or terminate accounts that violate this section, and we may remove content that we reasonably believe violates these Terms.

The Service uses generative models. Output Content is produced programmatically and may include inaccuracies, artifacts, unintended variations, or content that does not match your expectations. While our models are trained to respect the structural integrity of your inputs, we cannot guarantee pixel-perfect fidelity. You are responsible for reviewing Output Content before any commercial or public use.

The Service — including the underlying software, models, user interface, branding, documentation, and selection and arrangement of features — is owned by Hues AI or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service in accordance with these Terms, we grant you no rights in our intellectual property.

Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

You may stop using the Service and close your account at any time. We may suspend or terminate your access — with or without notice — if you breach these Terms, if your use creates meaningful risk to us or other users, or if required by law. Upon termination, your right to use the Service ends, and any unused credits or pre-paid amounts are forfeited unless applicable law requires otherwise. Sections that by their nature should survive termination — including ownership provisions, disclaimers, limitations of liability, and dispute resolution — will survive.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, secure, or error-free. Any output, recommendation, or rendering produced by the Service is provided for your evaluation; we do not warrant that it is fit for any specific commercial use.

To the fullest extent permitted by law, Hues AI and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $100. Some jurisdictions do not allow these limitations, in which case the limitations apply only to the extent permitted.

You agree to defend, indemnify, and hold harmless Hues AI and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your Input Content, your use of Output Content, your violation of these Terms, or your violation of any law or third-party right.

We may modify the Service or these Terms from time to time. Material changes will be reflected by an updated date at the top of this page and, where appropriate, by additional notice through the Service or by email. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.

These Terms are governed by the laws of the Kingdom of Thailand, where Hues Global Co., Ltd. is incorporated, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the competent courts of Thailand, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

These Terms, together with our Privacy Policy and any plan- or feature-specific terms presented to you in the Service, constitute the entire agreement between you and Hues AI regarding the Service. If any provision is held unenforceable, the remaining provisions will remain in full effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
